Terms of Use – Badge Sales and Distribution
Welcome to Caregiver ID (“Website”). By accessing and using this Website for the purchase and distribution of caregiver and clinician identification badges (“Badges”), you (“User,” “you,” or “your”) agree to comply with and be bound by the following Terms of Use (“Terms”). Please read these Terms carefully before using our services.
- Acceptance of Terms:
By using this Website, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must not use our services.
- Eligibility and User Responsibilities:
- Authorized Entities: This Website is intended for use by caregivers, clinicians, schools, home health agencies, registries, and home health schools (“Authorized Entities”) who require Badges for their personnel.
- Verification of Credentials:
- Users are solely responsible for verifying the accuracy and validity of all training certificates, licenses, and other credentials submitted for Badge creation.
- Users must ensure that all personnel for whom Badges are purchased meet all applicable state laws and regulations related to caregiver and clinician qualifications.
- Users must verify that all personnel meet continuing education requirements mandated by the state.
- Users are responsible for verifying that all personnel have completed a background check that aligns with all applicable state laws.
- Users are responsible for verifying that all personnel have a health statement that declares that they are free from communicable diseases.
- Purchases: If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
- You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
- The service may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
- Order Minimums: In regard to Custom Printed ID Cards, there are no minimum order quantities to order from us!
- Accuracy of Information: Users must provide accurate and complete information for Badge creation, including but not limited to, names, titles, photo ID verification, unfiltered passport-sized photographs, and credential details.
- Compliance with Laws: Users must comply with all applicable local, state, and federal laws and regulations regarding the use and distribution of Badges.
- User Responsibility: Users are responsible for the proper use and distribution of the badges that are purchased.
- Badge Sales and Distribution:
- Order Placement: Orders for Badges must be placed through the Website’s designated ordering process.
- Payment: Payment for Badges must be made through the Website’s secure payment gateway.
- Shipping and Delivery: Shipping and delivery terms will be provided during the ordering process.
- Ownership: All Badges remain the property of the Authorized Entity who purchased them.
- Intellectual Property: You own or have legal permission to use any, logo, photograph or text you submit for production. Caregiver ID is not liable for any copyright, trademark, or intellectual property claims arising from customer-submitted designs and or photo.
- Authorized Personnel: You are at least the age of majority in your state or province of residence, or you have consent from the (“Authorized Entities”) to order badge.
- Sales: All sales are final once an order is submitted. No refunds will be provided for custom orders, including but not limited to personalized ID badges, custom templates, or design services.
- Verification and Attestation:
- User Attestation: By purchasing Badges, Users attest that they have verified the credentials and qualifications of the personnel for whom the Badges are created.
- No Liability: This Website and its operators are not responsible for verifying the accuracy or validity of the credentials provided by Users. Users assume all liability for any misrepresentation of credentials.
- Audits: Users agree that they may be subject to audits, from time to time, to ensure that the information that has been provided is accurate.
- Shipping Information: Products can be shipped to all fifty (50) states, as well as APO and FPO addresses, Puerto Rico and other territories. Where applicable, delivery confirmation code shall be used to determine delivery status to the address for orders shipped domestically via Best Way, Priority Mail, Two-Day Mail, and Overnight Mail. Orders shipped that carry a USPS Delivery Confirmation code shall be used to determine whether the item has been delivered to the provided address. Orders shipped with “economy”, “free”, and standard international methods may not have an assigned tracking code. All reprints and reshipments will be shipped via “economy” method and may not have a shipping confirmation code. CAREGIVERID shall not be responsible for mail which the Delivery Confirmation Service shows as having been delivered or packages that are undeliverable and have not been returned to us yet. We will strive to find a shipping method that fits End User’s needs, but cannot guarantee availability. End User is solely to ensure the shipments are received at the address provided by the End User. End User hereby waives all rights to complain about an “Item Not Received” payment dispute claim when the parcel is received by the shipping courier. Be sure the address you input is accurate during checkout.
- Cancellation, Returns & Exchange:
Order Cancellations: Requests for order cancellation must be made within 24 hours of placing an order, and prior to an order being shipped. We do not guarantee cancellation of custom order requests. Once such orders reach our production line, they are not subject to refunds. Because our turnaround times are so fast, orders are sent to production quickly, so please make sure they are correct when ordering. Since each badge is personalized and printed based on your specifications, we do exchanges or refunds.
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. Defective products may include Custom products containing misprints or defects not due to user error, any product visibly damaged upon receipt.
If you would like to return one or more of the products bought from CaregiverID please email customer service department Support@caregiverID.com within 3 days of receipt of products referencing (1) your order number (2) the products you would like to return and (3) the reason you want to make a return.
If you do not contact CaregiverID prior to shipping products to our facility a refund will not be processed. Returns to IDCREATOR by pre-paid freight (return shipping paid for by PURCHASER).
- Limitation of Liability:
- This Website and its operators shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or relating to the use of this Website or the Badges.
- Users agree to indemnify and hold harmless this Website and its operators from any claims or liabilities arising from the use or misuse of the Badges.
- Modifications to Terms:
- We reserve the right to modify these Terms at any time.
- Refuse service to any customer at our sole discretion.
- Cancel orders without prior notice if we suspect fraudulent, abusive, or unlawful activity.
- Change pricing, product availability, or site functionality without notice
Any changes will be posted on this Website, and your continued use of the Website constitutes acceptance of the modified Terms.
- Governing Law:
- These Terms shall be governed by and construed in accordance with the laws of the State of Florida without regard to its conflict of law principles.
